Rule

Withdrawal of application

19.—(1) An application may be withdrawn at any time at the request of the applicant provided that the request is made in writing and the tribunal agrees.

(2) If a patient ceases to be liable to be detained or subject to guardianship [or after-care under supervision][1] in England and Wales, any application relating to that patient shall be deemed to be withdrawn.

[(2A) Where a patient subject to after-care under supervision fails without reasonable explanation to undergo a medical examination under rule 11, any application relating to that patient may be deemed by the tribunal to be withdrawn.][1]

(3) Where an application is withdrawn or deemed to be withdrawn, the tribunal shall so inform the parties and, in the case of a restricted patient, the Secretary of State.
