The MHA had previously been amended to allow NHS Foundation Trusts to exercise their s23 power of discharge only through non-executive directors. This was proving too much of a burden when arranging hospital managers' hearings, so now those Trusts are treated the same as other Trusts. This amendment came into force on 24/7/07 (Mental Health Act 2007 (Commencement No. 1) Order 2007).
