Briley v Leicester Partnership NHS Trust [2023] EWHC 1470 (SCCO)

Pre-inquest costs Legal Aid for an inquest ran alongside CFAs for civil litigation. Pre-inquest work would have been recoverable under Legal Aid but was instead claimed from the defendant at market rates when the litigation concluded successfully. The costs judge decided that this work was recoverable from the defendant.
