With effect from 10/7/08, the functions under MHA 1983 s86, so far as exercisable in relation to Wales, are transferred to the Welsh Ministers - except in relation to a patient who is subject to one or more of:

(i) a restriction order made under s41
(ii) a hospital direction made under s45A(3)(a)
(iii) a limitation direction made under s45A(3)(b)
(iv) a restriction direction made under s49
