The requirement to pass an automatic life sentence for the second serious sexual or violent offence in the absence of exceptional circumstances, even for a mentally-disordered offender, did not breach Article 3 or 5.

Notes
The automatic life sentence provisions (under s109 Powers of Criminal Courts (Sentencing) Act 2000) were replaced with the Imprisonment for Public Protection provisions for offences on or after 4/4/05.
