Mandatory and discretionary references

The hospital managers will make a reference to the MHRT:

• s3: after six months if no application has been made (s68(1)).

• s3: when the section is renewed and there had been no MHRT for three years (one year for under 16's) (s68(2)).

The Secretary of State (for Health):

• Part II patients: at any time (s67(1)

Home Secretary:

• Restricted patients: at any time (s71(1)).

• Restricted patients: where no MHRT for three years (s71(2)).
