===17/5/12: Making of the Mental Health (Primary Care Referrals and Eligibility to Conduct Primary Care Assessments) (Wales) Regulations 2012===
On 15 May 2012 the National Assembly for Wales approved the Mental Health (Primary Care Referrals and Eligibility to Conduct Primary Care Assessments) (Wales) Regulations 2012.

These Regulations are made in support of Parts 1 of the Mental Health (Wales) Measure 2012.

The Regulations enable primary care providers to refer a person who is entitled to receive primary medical services and who appears to be in need of a primary mental health assessment for such an assessment provided that the person does not fall within a category of person described in section 8(1) of the Measure.

The Regulations also set out eligibility requirements, including professional requirements, in regard to persons who may undertake primary mental health assessments under Part 1 of the Mental Health (Wales) Measure 2010 (the Measure).

===9/5/12: The Mental Health (Secondary Mental Health Services) (Wales) Order 2012===
Please note that the draft Mental Health (Secondary Mental Health Services) (Wales) Order 2012 have been laid in the National Assembly for Wales.  They are due to be debated in the Plenary session of the Assembly on 29 May 2012.  A copy of the Order can be accessed here:

===9/5/12: Making of the Mental Health (Regional Provisions) (Wales) Regulations 2012===
On 8 May 2012 the National Assembly for Wales approved the Mental Health (Regional Provisions) (Wales) Regulations 2012.

These Regulations are made in support of Parts 1 and 3 of the Mental Health (Wales) Measure 2012.

The Regulations enable mental health service providers in Wales - Local Health Boards and local authorities - to develop and deliver local primary mental health support services under Part 1 of the Measure on an LHB-wide basis in Wales (rather than separately for each local authority area).

The Regulations also enable LHBs and local authorities to agree arrangements for dealing with requests for assessment under Part 3 of the Measure on an LHB-wide basis (again, rather than separately for each local authority area).

===24/4/12: Laying of the Code of Practice to Parts 2 and 3 of the Mental Health (Wales) Measure 2010===
The Code of Practice to Parts 2 and 3 of the Mental health (Wales) Measure 2010 was laid yesterday, 23rd of April, before the National Assembly for Wales in accordance with the requirements of section 44 of the Measure. Provided that a resolution is not raised in the Assembly for it's withdrawal during a period of 40 non recess days then the Code will be published and will be in force when Parts 2 and 3 of the Measure commence on the 6th of June 2012.

===23/2/12: Consultation on draft Regulations under the Mental Health (Wales) Measure===
On Monday, the Welsh Assembly Government began a twelve week consultation exercise on three sets of Regulations associated with the Mental Health (Wales) Measure 2010.  These draft Regulations are –

·       The Mental Health (Care Coordination and Care and Treatment Planning) (Wales) Regulations 2011

·       The Mental Health (Assessment of Former Users of Secondary Mental Health Services) (Wales) Regulations 2011

·       The Mental Health (Independent Mental Health Advocates) (Wales) Regulations 2011

===16/1/12: Mental Health (Wales) Measure 2010 - Care and Treatment Plan template===
Further to the emails below, please find attached Welsh and English language versions of the Care and Treatment Plan template which was agreed by the National Assembly for Wales in December 2011.

From 6 June 2012 mental health services in Wales will be required to deliver the care coordination and care and treatment planning provisions of Part 2 of the Mental Health (Wales) Measure 2010 and the [[Mental Health (Care Co-ordination and Care and Treatment Planning) (Wales) Regulations 2011]].

The Care and Treatment Plan templates attached here meet the requirements of this legislation:

On Tuesday 8 November 2011 the Minister for Health and Social Services laid before the National Assembly for Wales the Mental Health (Care Coordination and Care and Treatment Planning) (Wales) Regulations 2011 along with an accompanying Explanatory Memorandum.  These Regulations are being introduced under Part 2 of the Mental Health (Wales) Measure 2010.

These Regulations have been scheduled for debate by Assembly Members in the Senedd on Tuesday 29 November 2011. 
A formal consultation process took place in relation to these Regulations earlier in the year, and the consultation response report from this exercise can be accessed via the attached hyperlink:

The report contains a copy of the revised Care and Treatment Plan template which the legislation requires services to adopt from June 2012 (if these Regulations are agreed by the National Assembly).  The Care and Treatment Plan template will be appended to the final version of the Code of Practice to Parts 2 and 3 of the Mental Health (Wales) Measure 2010 when this is published in early 2012.  In the meantime, copies of the template in English and Welsh are attached here for ease of reference:

On 7 November 2011 the Welsh Government began a formal consultation on the draft [[Mental Health (Primary Care Referrals and Eligibility to Conduct Primary Mental Health Assessments) (Wales) Regulations 2012]].

These Regulations propose arrangements which will enable GPs to refer individuals to local primary mental health support services (including individuals who are not registered with them).  The Regulations also set out eligibility requirements for those who may undertake primary mental health assessments.

The consultation period begins on 7 November 2011 and all responses must be submitted to the Welsh Government's Mental Health Legislation Team no later than 27 January 2012.

On Tuesday 18 October 2011 the National Assembly for Wales debated and approved two sets of Regulations associated with the Mental Health (Wales) Measure 2010: the [[Mental Health (Assessment of Former Users of Secondary Mental Health Services) (Wales) Regulations 2011]] and the [[Mental Health (Independent Mental Health Advocates) (Wales) Regulations 2011]], along with accompanying Explanatory Memoranda and Regulatory Impact Assessments.

The Mental Health (Independent Mental Health Advocates) (Wales) Regulations 2011 will come into force insofar as they relate to Welsh qualifying informal patients on 2 April 2012, and for all other purposes on 3 January 2012.

The Mental Health (Assessment of Former Users of Secondary Mental Health Services) (Wales) Regulations 2011 will come into force on 6 June 2012.

On 26 September 2011 the Welsh Government began a formal consultation on the draft Mental Health (Regional Provision) (Wales) Regulations 2012.

If made, this subordinate legislation would enable Local Health Boards and local authorities in Wales to enter into regional working arrangements to deliver local mental primary mental health support services under Part 1 of the Mental Health (Wales) Measure 2010, and in making arrangements for the provision of assessments for former users of secondary mental health services under Part 3 of the Measure.

The consultation period begins on 26 September 2011, and all responses must be submitted to the Welsh Government's Mental Health Legislation Team no later than 16 December 2011.

Please find attached a copy of the Welsh Government's Mental Health (Wales) Measure 2010 National Service Model for Local Primary Mental health Support Services.

Part 1 of the Mental Health (Wales) Measure 2010 places duties on Local Health Boards and local authorities to work together to make local primary mental health support services available to people of all ages across Wales.  This National Service Model will assist the delivery of these services.  It provides guidance to these bodies in meeting their Part 1 duties: it sets out the duties, functions and objectives of local primary mental health support services, and gives guidance on the requirements for the delivery of the services and the operational arrangements which are needed to support that delivery.

In March 2010 the Welsh Assembly Government introduced the proposed Mental Health (Wales) Measure to the National Assembly for Wales.  Since then the Measure has progressed through the four-stage Assembly scrutiny process.

The Measure was agreed in its final form by the National Assembly for Wales in plenary on 2 November and submitted for Royal Approval by Her Majesty the Queen in Privy Council thereafter.

On Wednesday 15 December, the Measure received Royal Approval.  This concludes the legislative process and the Measure will now be brought into force incrementally from next year.

The Measure is concerned with –

*Local primary mental health support services;
*Care coordination and care and treatment planning within secondary mental health services;
*Assessment of former users of secondary mental health services;
*Independent mental health advocacy.

The Welsh Assembly Government is currently developing subordinate legislation to be made under the Measure, and consultation on this will take place during spring 2011.  Work on the pre-implementation delivery programme has also begun.

You will receive a further update when the consultation on the subordinate legislation begins in the new year.  In the meantime, if there are any issues in relation to the Measure that you would wish to discuss, please do not hesitate to contact us.

You will be aware that the proposed Mental Health (Wales) Measure has been progressing through the National Assembly for Wales' scrutiny process for the past 8 months.

On Tuesday a milestone was reached as the National Assembly for Wales in plenary considered and passed the Measure in its final form.  The debate can be viewed on Senedd TV via the attached link:

Tuesday’s approval concludes the National Assembly's consideration of the Measure.  There will now follow a four week period during which the Counsel General, Attorney General, and Secretary of State for Wales may refer the proposed Measure to the Supreme Court for a decision on legislative competence.  If this does not happen, the proposed Measure will be submitted for approval by HM the Queen in Council, which will conclude the legislative process.
