Declaration of death Following an out-of-hours COP decision which permitted brain stem testing, the Trust issued proceedings in the Family Division (opposed by family members) for a declaration under the inherent jurisdiction that the patient had died, along with consequential declarations that it was lawful for doctors to withdraw ventilatory support.
