The Mental Health Act (MHA or the Act) provides the legal framework for the detention in hospital of people who are deemed to be suffering from mental disorder. The MHA Code of Practice (the Code) is an important document, which provides guidance to mental health services and on how the MHA should be used lawfully, protecting the rights and best interests of those in need of support and care.

The role of the MHA Administrator is important because it provides a framework for compliance with the Mental Health Act by identifying and challenging any errors. Mental Health Administrators have a vital role in safeguarding the legal requirements of the Mental Health Act.

The key duties of the Mental Health Administrator include:

  • Receipt, scrutiny and rectification of documents to ensure they are legally correct and valid, ensuring the relevant information, signatories and permissions are obtained and recorded in accordance with the requirements of the MHA and Code of Practice.
  • Ensuring that Section expiry dates are dealt with within statutory timeframes.
  • Co-ordinating hospital manager reviews and Mental Health Tribunals. Organising and servicing all required meetings, ensuring the effective and timely production, collation and distribution of reports, minutes and other relevant documentation
  • Ensuring that all detained patients are aware of their rights and that this is recorded.
  • Giving advice to staff and patients when required.
  • Ensuring patients, their relatives, legal representatives and official agencies are provided with the information and documentation required to effect the detention, registration and admission of an individual under the provisions of the MHA.
  • Liaising with clinicians, external professionals, patients, their families, legal representatives and official agencies.
  • Receiving and responding to enquiries and requests for information in accordance with company policy, service level agreements and statutory regulations
  • Ensuring that all information and documentation is correctly processed in line with policies and procedures in order that regulatory and statutory requirements are met.
  • Maintaining the audit trail, ensuring up-to-date and accurate information can be provided or accessed as required
  • Seeking to improve processes and the general flow of information so that the department can operate efficiently
  • Meeting Key Performance Indicators
  • Day-to-day administration of the Mental Health Act.
  • Co-ordinate patient CPA (Care Programme Approach) meetings, including taking minutes to a high standard and distributing these in a timely manner.
  • Attend and take minutes at patient ward rounds.

To be successful as a MHA Administrator, you’ll need:

  • Excellent written and verbal communication skills
  • Excellent organisational skills within a fast-paced environment
  • Ability to prioritise workload to meet tight deadlines
  • To be highly motivated and work with and without direction
  • To demonstrate a positive work ethic and professionalism, as you will be liaising with a variety of professionals within the patient’s care team
  • To work well with systems and procedures
  • Education to GCSE level standard
  • To be competent in the use of standard office applications such as Word, PowerPoint and Excel
  • Experience of taking minutes at meetings to a high standard
  • A minimum of 2 years' previous experience within a relevant administrative or clinical role (desirable)
